Incy Wincy Web Design provides the following services:

• Custom web design and development.
• Website maintenance and updates.
• Web hosting and domain registration assistance (if applicable).

We strive to deliver quality work that meets the agreed-upon specifications. A detailed project scope will be discussed and agreed upon before work commences.

4. Pricing and Payment

• Pricing: All prices are quoted in Euro €. 
• Deposit: A non-refundable deposit of 50% is required to begin work. The remaining balance is due upon project completion.
• Payment Terms: Full payment is due within 14 days of project completion unless otherwise agreed in writing.
• Payment Plans: Payment plans are available with all packages. Please contact us to discuss terms. 
• Late Payments: Failure to pay within the specified time may result in a suspension of services, including withholding website access or deliverables, until payment is made.

5. Project Timelines

• Project Delivery: We will provide a timeline for project completion at the outset. Delays may occur due to client feedback, changes in project scope, or unforeseen technical issues.
• Client Responsibilities: Timely provision of content, feedback, and any necessary approvals from the client is essential for meeting deadlines.

6. Revisions and Changes

We offer a reasonable number of revisions at no additional charge. Any changes or revisions beyond this will incur extra fees, which will be communicated to the client in advance.

7. Website Content and Responsibility

• Client-Supplied Content: The client is responsible for providing accurate and lawful content (text, images, videos, etc.) for the website.
• Copyright: You guarantee that any content you provide does not infringe on third-party intellectual property rights. You indemnify us against any claims related to the content provided by you.

8. Intellectual Property Rights

Upon full payment, the client will own the rights to the final website design, content, and materials created specifically for their project. However, we reserve the right to use any designs for marketing purposes (e.g., in our portfolio) unless the client requests otherwise in writing.

9. Third-Party Services

If we recommend third-party services (e.g., hosting providers, email services), we are not responsible for their performance, terms of service, or costs. The use of such third-party services is governed by their terms and conditions.

10. Warranties and Disclaimers

• We do not guarantee that our services will be error-free or uninterrupted. We will, however, work to resolve any issues as quickly as possible.
• Incy Wincy Web Design provides no warranties for third-party products or services integrated into your website.
• We are not liable for any loss or damage caused by errors, omissions, or interruptions in the services provided unless resulting from gross negligence.

11. Limitation of Liability

Incy Wincy Web Design will not be liable for:

• Loss of profits, revenue, or business opportunities.
• Any indirect or consequential losses arising from the use of our services.
• Any claims, losses, or damages caused by the client’s failure to comply with these Terms.

Our maximum liability to the client, under any circumstances, is limited to the total fees paid by the client for the service in question.

12. Termination

Either party may terminate the agreement at any time with 30 days’ written notice. However, termination by the client does not absolve them from any fees due for services rendered up to that point.

We reserve the right to terminate the agreement immediately if the client breaches these Terms or engages in unlawful activity through their website.

13. Force Majeure

We will not be held responsible for any delays or failure to perform services due to circumstances beyond our control (e.g., natural disasters, strikes, technical failures).

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Ireland. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ireland.

15. Changes to Terms

We reserve the right to update these Terms and Conditions at any time. Significant changes will be communicated via email or by posting a notice on our website. Continued use of our services after such changes constitutes your acceptance of the new terms.
